1. Acceptance

These terms govern your use of midgardscientific.com (the “Site”), operated by Midgard Scientific, LLC (“Midgard Scientific,” “we,” “us”). By accessing or using the Site you agree to them. If you do not agree, please do not use the Site.

2. These terms cover the Site, not our services

This is important. Nondestructive testing, Level III consulting, training, certification, and any other services we perform are governed exclusively by a separate written agreement, quotation, statement of work, or purchase order accepted by us — not by these terms. Nothing on this Site constitutes an offer to perform services, a quote, or a binding commitment, and no engagement exists until it is agreed in writing.

3. Information on the Site is general

Descriptions of methods, standards, capabilities, and applications on this Site are provided for general information. They are not engineering advice, not an inspection recommendation, and not a substitute for the judgement of a qualified Level III or the requirements of the code, specification, or contract that applies to your work. Method selection, acceptance criteria, and inspection intervals depend on facts specific to your asset. Do not rely on this Site to make an inspection, repair, fitness-for-service, or safety decision — contact us and we will address your actual requirement.

References to codes and standards such as ASTM, ASME, NAVSEA, API, AWS, ASNT, SNT-TC-1A, CP-189, and NAS410 are for identification only. Those documents are published and controlled by their respective organizations, and you are responsible for obtaining and complying with the current revision applicable to you.

4. Permitted use

You may view, download, and print material from the Site for your own internal business use. You agree not to:

• Use the Site for any unlawful purpose, or in violation of any export control, government contracting, or security requirement
• Copy, republish, sell, or redistribute Site content for commercial purposes without our written permission
• Attempt to gain unauthorized access to the Site, its hosting infrastructure, or any connected system
• Introduce malware, or interfere with the operation, integrity, or availability of the Site
• Scrape or harvest content or contact details by automated means, or use them to send unsolicited communications
• Misrepresent your affiliation with Midgard Scientific, or imply an endorsement or certification we have not given

5. Intellectual property

The Site and its content — including text, layout, graphics, and the Midgard Scientific name and logo — are owned by Midgard Scientific, LLC or its licensors and are protected by intellectual property law. Third-party marks and standard designations belong to their respective owners and are used for identification only. Except as stated in section 4, no licence or right is granted.

6. Unsolicited submissions

Please do not send confidential, proprietary, export-controlled, or classified information through the Site or by unencrypted email. Information you send us outside a signed agreement or non-disclosure agreement will not be treated as confidential, and we assume no obligation with respect to it.

7. Availability

We may change, suspend, or discontinue any part of the Site at any time without notice, and we do not guarantee that it will be available, uninterrupted, or error-free.

8. Third-party links

The Site may link to third-party websites. We provide those links for convenience only. We do not control, endorse, or accept responsibility for their content, availability, or practices.

9. Disclaimer of warranties

The Site and its content are provided “as is” and “as available,” without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, or accuracy or completeness of content. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Midgard Scientific, LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or relating to your use of or inability to use the Site — even if advised of the possibility. Our total aggregate liability arising out of or relating to the Site will not exceed one hundred US dollars (US$100). This section does not limit liability that cannot be limited under applicable law, and it does not apply to services performed under a separate written agreement, which carries its own terms.

11. Indemnity

You agree to indemnify and hold harmless Midgard Scientific, LLC from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Site or your breach of these terms.

12. Governing law

These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of laws rules. You agree that the state and federal courts located in Georgia have exclusive jurisdiction over any dispute arising out of or relating to the Site or these terms.

13. Changes to these terms

We may revise these terms at any time. The date at the top of this page shows when they were last changed, and your continued use of the Site after a revision means you accept it.

14. Severability

If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.
